Welcome to FluxArt! These Terms & Conditions ("Terms") govern your access to and use of our website, applications, and services (collectively, the "Services"). Please read these Terms carefully before using the Services. By accessing or using the Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, then you may not access the Services.

1. Account Creation and Access

  1. Eligibility: You must be at least 18 years old to create an account or use the Services. By creating an account, you confirm that you are 18 or older and have the legal capacity to enter into these Terms.
  2. Account Registration: You may be required to create an account to access certain features of the Services. You agree to provide accurate, current, and complete information during registration and to keep such information updated. You are responsible for maintaining the confidentiality of your account password and for all activity that occurs under your account.
  3. Account Access: You may access your account using your email address and password or by using your Google account credentials. You are solely responsible for maintaining the confidentiality of your account login information.
  4. How you accept these Terms: You accept these Terms and the Acceptable Use Policy when you click the button to create your account or continue with Google. We keep a record of the version you accepted and when.

2. Trial Credits and Subscription Plans

  1. Trial Credits: When you create an account, you receive a promotional welcome bundle of 50 Premium Credits and 1 Quality Boost credit to evaluate the Services. FluxArt also offers 10 Basic Credits each day (UTC) when you claim them ("Basic Credits") while your account remains in good standing. Basic Credits support image generation with the Basic model only and do not enable edit workflows. Trial and Basic Credits are promotional, non-transferable, and FluxArt may adjust amounts, eligibility, or availability at any time. Promotional credits may be withheld from an account that appears to duplicate another account to obtain extra free credits, as described in our Privacy Policy.
  2. Subscription Plans: You can subscribe to a monthly or annual plan. Each plan offers a specific number of Premium Credits per billing cycle.
  3. Unlimited Relax generations: Some plans include Unlimited Relax generations on selected models (currently FluxArt Express and FluxArt Studio). Relax generations are subject to fair use: after heavy use in a day, new Relax images take longer to generate until the limit resets at 00:00 UTC. Relax does not apply to other models or features.
  4. One-Time Credit Purchases: You may also choose to purchase a one-time Premium Credit package (a "top-up") instead of, or in addition to, a plan.

3. Payment and Fees

  1. Reseller: Purchases are sold and processed by Dodo Payments, our reseller and Merchant of Record, under Dodo Payments' Buyer Terms. Dodo Payments handles payment, invoicing, sales taxes and payment refunds.
  2. Subscription Renewal: Your subscription renews automatically at the end of each billing cycle unless you cancel it before the end of the then-current billing cycle. You will be charged the subscription fee for the next billing cycle at the then-current rates. You can cancel at any time from the Billing page.
  3. Taxes: Applicable sales taxes are calculated and collected by Dodo Payments at checkout. You are responsible for any other taxes related to your use of the Services.

4. Content Ownership, Publicity & License

  1. Your content: As between you and FluxArt, you own the prompts, settings and photos you submit ("Inputs"), and FluxArt does not claim ownership of the images you generate ("Outputs"). To the extent FluxArt has any rights in your Outputs, we assign them to you. Whether an Output is protected by copyright, and who owns it, depends on the law where you are and on your own creative contribution, so we do not promise that Outputs are protectable. Inputs and Outputs together are "User Content".
  2. License Grant to FluxArt: You grant FluxArt a non-exclusive, worldwide, royalty-free license to host, store, cache, reproduce, process, adapt (for example, resize, transcode, or create thumbnails), and display your User Content, and to share it with our service providers, only as needed to operate and provide the Services to you, run our safety checks, enforce these Terms, and comply with the law. For public generations (see Section 4A), you also grant FluxArt the right to display them to other users, feature or rank them on FluxArt, and use them to promote FluxArt, including in emails, social posts, and ads. We do not use private generations or Uploaded Photos to promote FluxArt. FluxArt does not use your User Content to train generative AI models; we may use it to test and improve our safety rules. This license may be sublicensed only to service providers acting for us, and transferred only as part of a merger, acquisition, or sale of FluxArt. It ends when you delete the content or your account, except for the residual copies described in Section 4C and public content already used in promotional materials.
  3. Attribution & Profile Information: You authorize FluxArt to use your display name, handle, avatar, and public profile information to attribute your public User Content without additional compensation.

4A. Public-by-Default; Prompts & Settings

Images you generate—together with their prompts, negative prompts, seeds, and settings—are public by default and may be viewed by others once they have passed our automated safety checks. Do not submit confidential or proprietary information. Paid plans can create private generations, which are not shown on Explore or your public profile but are subject to the same automated safety checks. Private images are stored at unlisted links, so anyone you share an image link with can open it. Uploaded Photos are never public, and images made from an uploaded photo are not listed on Explore.

4B. No Compensation from Engagement

FluxArt does not pay or compensate creators based on views, likes, rankings, featuring, or similar metrics. Featuring or promotion does not create any entitlement to payment, reward, or revenue share. From time to time, FluxArt may offer optional creator programs (e.g., contests, leaderboards, referral programs); participation is governed by separate written terms that FluxArt may modify or terminate at any time.

4C. Residual Copies; Deletion Effects

When you delete User Content or close your account, FluxArt stops showing the content within a reasonable time and deletes it as described in our Privacy Policy. Copies may remain for a limited time in database backups, in our image providers' systems under their own retention periods, and in CDN caches. We may also keep records we need for security, fraud prevention, legal claims, or legal obligations.

4D. Outputs, Commercial Use & Model Providers

  1. Commercial use: On any plan, including Free, you may use your Outputs for personal and commercial purposes, subject to these Terms, the Acceptable Use Policy, applicable law, and the rights of others.
  2. Your responsibility: You are responsible for how you use Outputs. Outputs can resemble existing works, brands, or people. Make sure your use does not infringe anyone's copyright, trademark, privacy, or publicity rights.
  3. No guarantees about Outputs: Outputs are generated automatically and may be inaccurate or unexpected. Similar or identical Outputs may be generated for other users. We do not guarantee that Outputs are unique, fit for a particular purpose, or free from third-party rights.
  4. Model providers: FluxArt runs image models from third-party providers. By using a FLUX model from Black Forest Labs in FluxArt, you agree to be bound by the then-current Black Forest Labs Terms of Service. Our Acceptable Use Policy is at least as strict as the usage policies of our model providers.

5. Privacy

  1. Privacy Policy: Our Privacy Policy explains how we collect and use your personal information when you use the Services.
  2. Public Content Reminder: Generated images and associated prompts/settings are public by default as set out in Section 4A. Prompts, uploads, and generated images are screened automatically as described in Section 6C and our Privacy Policy.

6. Prohibited Conduct

FluxArt is a safe-for-work service. Our Acceptable Use Policy forms part of these Terms. You agree not to create, upload, request, or share, and not to attempt to create:

The Acceptable Use Policy describes in more detail which content and edits are allowed. If the Acceptable Use Policy and these Terms conflict on content rules, the stricter rule applies.

6B. Uploaded Photos

  1. Your rights and consent: By uploading a photo, you represent and warrant that you own it or have all rights needed to use it, and that every identifiable person in it has given permission for it to be uploaded and edited as you request.
  2. How we handle Uploaded Photos: Photos you upload as a source for edits ("Uploaded Photos") are screened automatically before use, stored privately, never shown to other users, used only to perform your requested edit and our safety checks, not used by FluxArt to train generative models, and deleted automatically within 7 days.
  3. Refused photos: Photos that fail our checks are deleted and cannot be used.

6C. Content Moderation and Enforcement

  1. Automated checks: We check prompts, uploaded images, requested edits, and generated images automatically, using our own rules and third-party moderation services, before any image is saved or shown. We may refuse any request, and discard, hold for review, or remove any content that we believe breaks these Terms or the Acceptable Use Policy.
  2. Credits: No credits are used for requests refused before generation. Credits for images that our checks discard or hold for review are returned automatically; if a held image is later released to you, it is free (see Section 8).
  3. Restrictions: Repeated violations may pause or suspend your ability to generate, and we may close accounts as described in Section 7.
  4. Reporting: We may preserve information about content that may be illegal, including any sexual content involving minors, and report it to law enforcement or other appropriate authorities. We will do so where the law requires.

7. Takedown, Termination & Account Closure

  1. By You: You may request removal of your public items by contacting support at support@fluxart.ai, and anyone may report content that breaks our rules the same way. We remove content that breaks our rules promptly, and within any time limit the law requires. You acknowledge that third-party caches, search engines, archives, or shares are outside FluxArt’s control.
  2. By Us: We may suspend or terminate your access to the Services if you breach these Terms or the Acceptable Use Policy, if the law requires it, or to protect FluxArt, its users, or others from harm or fraud. Where practical, we will tell you why. If we close your account or stop offering the Services for any other reason, we will refund the unused part of any prepaid subscription period.
  3. Account Closure: You can ask us to delete your account by emailing support@fluxart.ai from the email address on your account. We delete your account data within 30 days of verifying the request, except records we must keep for legal, tax, fraud-prevention, or safety reasons and the residual copies described in Section 4C.

8. Refund and Cancellation Policy

  1. Trial Credits: Trial Premium Credits and Basic Credits are non-refundable and may be changed or discontinued at any time. Unused promotional credits may expire as communicated in-product or in these Terms.
  2. Subscriptions: You can cancel your subscription at any time from the Billing page. Cancelling stops renewal; your plan and its credits stay available until the end of the current billing period. When the period ends, your plan returns to Free and that period's unused plan credits end; credits you bought separately as top-ups stay on your account. Subscription fees for the current billing period are not refunded.
  3. One-Time Credit Purchases: One-time credit package purchases are final and non-refundable, except where required by law.
  4. Automatic Credit Returns: Credits (Premium, Quality Boost, and Basic) are returned automatically when a generation fails on the provider's side or when our content safety checks discard its result or hold it for review. See our Refund & Cancellation Policy for details.

9. Disclaimers

  1. No Warranties: The Services are provided "as is" and "as available" without warranty of any kind, express or implied. We do not warrant that the Services will be uninterrupted or error-free, that defects will be corrected, or that the Services are free of viruses or other harmful components.
  2. Limitation of Liability: To the maximum extent permitted by applicable law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; or (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.
  3. Your legal rights: Nothing in these Terms limits any rights you have under consumer protection or other laws that cannot be waived or limited by contract.

10. Beta / Experimental Features

Certain features may be offered as beta or experimental and may change, break, or be withdrawn at any time. FluxArt makes no promise that any specific feature will be available now or in the future.

11. Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of India, without regard to its conflict of laws provisions.

12. Entire Agreement; Severability

These Terms, together with the Acceptable Use Policy and the Refund & Cancellation Policy, constitute the entire agreement between you and us relating to the subject matter herein and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us. If any part of these Terms is found unenforceable, the rest of these Terms remains in effect.

13. Changes to These Terms

We may update these Terms from time to time in our sole discretion. If we make material changes to these Terms, we will notify you by email or through a prominent notice on the Services. Your continued use of the Services following the posting of any revised Terms constitutes your acceptance of the revised Terms.
